These Terms of Service ("Terms") govern your use of the SurgReport website and application (the "Service") operated by My Scope Diagnostic Solutions, trading as SurgReport ("we", "us", "our"). By accessing or using the Service, you agree to these Terms.

1. The Service

SurgReport is a surgical operative note documentation tool. It provides structured templates that help surgeons and trainees generate draft operative reports based on their clinical selections.

SurgReport is NOT a medical device. It does not provide medical advice, make clinical decisions, or replace professional surgical judgment. Every report generated by the Service is a draft that must be reviewed, edited, and approved by the responsible clinician before it is entered into the medical record.

2. Eligibility

The Service is intended for use by qualified medical professionals, surgical trainees, and healthcare workers involved in operative documentation. You must be at least 18 years old to use the Service.

Some features require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions are billed annually at the rate displayed at the time of purchase.

You may cancel your subscription at any time through the billing portal. Upon cancellation, you retain access until the end of your current billing period.

All content in the Service — including template text, option language, consent form content, teaching notes, controversies, landmark paper summaries, user interface design, and code — is the intellectual property of SurgReport and is protected by copyright. Your subscription grants you a personal, non-transferable, non-exclusive licence to use the Service for your own clinical documentation purposes.

We accept no liability for clinical decisions made based on content generated by the Service.

The Service does not collect, transmit, or store patient data. All patient information entered into the application is processed in your browser and stored locally on your device — it is never transmitted to our servers. Our servers handle authentication and subscription verification only. You are responsible for complying with all applicable data protection laws and regulations (including GDPR, HIPAA, or local equivalents) when using the Service.

8. Limitation of Liability

To the maximum extent permitted by law, SurgReport shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, clinical adverse outcomes, or business interruption, arising from or related to your use of the Service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
